GENERAL TERMS AND CONDITIONS OF SPORT LEITHNER AND SCHISCHULE PERTISAU

These general terms and conditions apply to all services and deliveries of Schischule Pertisau (hereafter referred to as “The Ski School”) and Sport Leithner.

SPORTS EQUIPMENT SUMMER and WINTER

1.    RESERVATION
Reservations for day and multi-day hire are possible at any time by booking via:
pertisau.skischool.shop or skipline.me/sportleithner

2.    RENTAL PRICES
must be paid in full at the time of reservation or booking on site, before the start of use, and can be paid in cash, by debit or credit card (VISA or Mastercard). The prices are the fixed prices for the desired equipment or equip-ment category advertised on the price lists. 
All rentals are valid for the calendar day. Daily hire means that the sports equipment is collected and returned on the same day. The specified return times must be adhered to by the customer. 
The prices for subsequent extensions may result in a higher sum than the immediate booking of the same period. 
•    Insurance
Hirers are liable for financial protection when using sports equipment. We recommend that you check your private household contents or liability insurance.
•    Special conditions winter
o    Discount on the hire of winter sports equipment (not for toboggans): Children 3-6 years receive a 50% discount, children 7-13 years receive a 30% discount.
A photo ID must be presented in order to receive the discount.
o    The rented winter sports equipment can be exchanged once free of charge within the rented category (three to five stars). When exchanging to a higher category, the surcharge according to the price list must be paid. No money will be refunded when changing to a lower category.

3.      RENTAL CONDITIONS
3.1     Rental contract
The hire contract is concluded between the customer and the hire shop. The booking becomes valid for the customer upon full payment and receipt of the e-ticket or on site after signing the rental contract. For the hire shop, the booking becomes valid upon receipt of the e-ticket and signing of the hire contract.
The customer must present an official photo ID (e.g. passport or driving licence) and agrees to a copy of this document being made.
3.2    Availability
The hire shop shall make all sports equipment available to the customer in accordance with the booking. If the booked sports equipment is not available when the customer arrives, the customer will receive a better or equivalent model from the hire shop's current hire stock at no extra cost. The hire shop cannot be held re-sponsible for delays in the issue of sports equipment due to circumstances for which the hire shop is not re-sponsible (e.g. accidents, delays in the return of previous rentals, force majeure, strikes, peak times in the hire shop).
3.3     Deposit
Renters deposit an identity card and credit card details (card number, expiry date, CVC number) or bank de-tails (SEPA). The hire shop may also request a deposit for the sports equipment, which will be refunded upon proper return of the sports equipment, i.e. after a check by the hire company's service department.
3.4     Collection
The customer must present their reservation in person at the hire shop. Upon request, the customer must present an official photo ID (e.g. identity card or driving licence) to the rental shop for identification or age ver-ification. The hire shop can copy these documents for the proper processing of the hire contract (in compli-ance with data protection regulations). 
The collection of sports equipment is generally possible from 8.30 a.m. on the first day of hire, ski equipment from 4 p.m. on the previous day at the earliest. 
The customer must inform himself/herself about the respective rental shop opening hours.
•    Late collection:
If the booked sports equipment is collected late or not at all by the customer, the hire price will not be refund-ed. Force majeure (unforeseeable events caused by external circumstances that could not have been pre-vented even with the utmost care) such as bad weather conditions or other influences for which the rental shop is not responsible do not entitle the customer to cancel the booking free of charge.

3.5     Return
The sports equipment must be returned by the customer on the last day of the agreed hire period, 30 minutes before closing time. Ski equipment may be returned by 9.30 a.m. on the following day at the lat-est.
The customer must inform himself/herself about the respective rental shop opening hours. The rented sports equipment must be returned in the condition in which it was taken over (normal wear and tear excluded). The hirer will be charged for any damage found during the service check carried out by the hire company following the return of the equipment.  
The Rental Firm reserves the right to press charges against the customer for theft/destruction and to claim compensation for lost services. The Rental Firm reserves the right to take further legal action.
•    Premature return
If the booked sports equipment is returned prematurely by the customer, the hire charge will not be re-funded.
•    Delayed return
If the sports equipment is used for a longer period of time and after consultation with the hire shop, the difference between the rental period actually used and the rental period already paid for must be paid on site at the usual rental prices.
If the rented sports equipment is not returned up to 30 minutes before closing time, an additional fee of 15.00 EURO will be charged, which must be paid upon return. If the sports equipment is returned after closing time, the daily rental fee for the following day will be charged.
3.6    Duty of care
With the booking or the personal entry at check-in, the customer confirms the accuracy of his personal data, which are used for the professional adjustment of the sports equipment. If the customer provides incorrect in-formation or changes the settings, the hire company's liability shall lapse.
Passing on the sports equipment to third parties is not permitted. 
The customer is fully responsible for the rented sports equipment and must treat it with care in accordance with its function and use it in the usual manner. 
When not in use during the hire period, the customer must ensure that the sports equipment is stored appro-priately to prevent confusion or theft. During the night, the sports equipment should be locked away with a suitable lock and kept in a locked room.
In the event of breakage or damage, the customer is liable for the repair costs or the current value. 
In the event of theft, the customer must demonstrably and immediately report the theft to the hire company within 24 hours and file a report with the relevant security authority. In the event of theft, the customer will be charged the value of the sports equipment, which is based on the current value.


SCHISCHULE PERTISAU 

1.     RESERVATION
Only the order or reservation confirmation from SCHISCHULE PERTISAU is authoritative for the acceptance of a reservation. Our cancellation conditions apply from this point in time. 

2.     COURSE PRICES
must be paid in full at the time of reservation or booking before the start of the course. The prices for subsequent extensions may result in a higher sum than the immediate booking of the same period. The specified times for the meeting point must be adhered to by the customer.

3.      SKI COURSES
•    SCHISCHULE PERTISAU does not guarantee that students will achieve a specific goal. SCHISCHULE PERTISAU has the option of changing the course to private lessons if it does not appear possible to achieve the course objective.
•    Due to the work in the terrain, exact adherence to the course dates cannot be guaranteed.
•    SCHISCHULE PERTISAU does not provide compensation for lessons cancelled due to cable car and lift system failures.
•    Due to the flexible organisation, the actual instructors may change - a possible change does not consti-tute a reason for cancellation. 
•    The instructions of the organising staff and the instructors must be followed at all times. 
•    SCHISCHULE PERTISAU reserves the right to change the lesson times. In such cases, customers will be informed by SCHISCHULE PERTISAU.
•    Children's courses take place without the presence of accompanying persons. If a child cannot attend the course without ongoing contact with an accompanying person, the child must leave the course and can only attend again when he/she is able to do so (in this case no refund will be made). Courses for beginner children under 5 years of age (Bambini) take place with specially trained instructors.
•    The courses start on Sunday or Monday. Advanced children can join the group courses until Thursday if capacity is available. 
•    2-hour group courses can be booked online in advance. 4-hour group courses are subject to seasonal conditions and can only be booked at the ski school office on the 1st day of the course.
•    The minimum number of participants for group courses (alpine or cross-country) is 3 people. If the group consists of 2 people, the course lasts 2 days. If the group consists of only 1 person, the course lasts 1 day. Children's group courses can be shortened or combined if there are 4 or fewer children. A guaranteed maximum group size is not agreed. If a maximum number of people is stated, this is an av-erage and may vary depending on the level of ability.
•    Courses take place in all weathers. If a course cannot be held due to force majeure (unforeseeable events caused by external circumstances that could not have been prevented even with the utmost care) such as bad weather conditions or other influences, SCHISCHULE PERTISAU reserves the right to postpone or cancel the course.
•    SCHISCHULE PERTISAU accepts no liability for any accidents that may occur before, during or after the ski lessons. Sufficient accident and liability insurance is the responsibility of the course participants. 
•    The costs for lifts and equipment are not included in the course price, unless otherwise stated in the course description. 
•    If the use of the Planberg and Wiesen lifts is included in the courses, the operating and usage condi-tions posted there apply.In the event of non-compliance with the terms and conditions of operation and use, course participants cannot take part in the lessons and are not entitled to any compensation.

General provisions for SPORT LEITHNER and SCHISCHULE PERTISAU

Injury and illness
We recommend travel and cancellation insurance. In the event of illness, SPORT LEITHNER and SCHI-SCHULE PERTISAU will issue a confirmation of the unused course or rental times on the basis of a domestic medical certificate for your travel insurance. If there are official orders/regulations (e.g. pandemic), there may be changes during the season.

Cancellation conditions
We recommend travel and cancellation insurance. Please inform us immediately of any planned changes.
•    One-off rebooking of services (courses, equipment, hire) up to 4 days before the start of the course: free of charge in consultation with the ski school office. Prerequisite: availability of the respective service.
•    Cancellation of services (courses, equipment, rentals) up to 3 days before the start of the course/rental: 80% processing fee. The remaining amount will be paid to an account specified by you.

Data protection
The processing of personal customer data is based on the fulfilment of the service/contract and is processed exclusively for this purpose.

Content of the online offer
SPORT LEITHNER and SKISCHULE LEITHNER (hereinafter referred to as ‘author’) accepts no liability for the topicality, cor-rectness, completeness or quality of the information provided. Liability claims against the author for material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are excluded unless the author can be proven to have acted wilfully or with gross negligence. All offers are subject to change and non-binding. The author expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without prior notice.

Place of jurisdiction, place of fulfilment and legal options
The place of fulfilment for all services is the registered office of the Pertisau Ski School, A-6213 Pertisau.
Austrian law applies exclusively to all legal disputes (excluding the IPRG).The competent court at the registered office of SPORT LEITHNER and SCHISCHULE PERTISAU shall have jurisdiction.The contractual language is German. Should individ-ual provisions of the GTC be invalid, these shall be replaced by analogous correct provisions. The other provisions shall re-main unaffected.
The course participant agrees that photos/film recordings made during the visit to SCHISCHULE PERTISAU may be published on the internet and in BOBO`s KINDERCLUB ski school brochures.

References and links
In the case of direct or indirect references to external websites (‘links’) that lie outside the author's area of responsibility, liabil-ity would only arise if the author was aware of the content and it was technically possible and reasonable for the author to prevent use in the case of illegal content.
