GENERAL TERMS AND CONDITIONS OF SPORT LEITHNER AND SCHISCHULE PERTISAU

These general terms and conditions apply to all services and deliveries of Schischule Pertisau (hereafter referred to as “The Ski School”) and Sport Leithner.


The acceptance of a reservation is solely based on the order or reservation confirmation of Pertisau Ski School. From this point onwards, our cancellation conditions apply. The Ski School does not guarantee that the student will achieve a specific goal. If it appears that achieving the course objective is not possible, The Ski School has the option to change the course to private lessons. Due to work in the field, exact adherence to course dates cannot be guaranteed. The Ski School does not provide compensation for lesson times lost due to the closure of cable car and lift facilities. Due to the flexible organization, the actual instructors may change – a change in instructor does not constitute grounds for cancellation. It is imperative to follow the instructions of the organizational staff and instructors. The Ski School reserves the right to change the lesson times. In such cases, customers will be informed by The Ski School.
Children's courses take place without the presence of accompanying persons. If a child is unable to participate in the course without ongoing contact with an accompanying person, they must leave the course and can only participate again when they are capable (in this case, no refund will be provided). Courses for beginner children under 5 years old (Bambini) are conducted by specially trained instructors. The courses start on Sunday or Monday. Advanced children can join the group until Thursday subject to availability. Prior to the course, the 2-hour group course can be booked online; 4-hour courses depend on seasonal conditions and can only be booked after the allocation on the 1st day of the course at The Ski School office.
The minimum number of participants for group courses (alpine and cross-country skiing) is 3 persons. If the group is reduced to 2 participants, the course lasts for 2 days, and if there is only 1 participant in the group, the course lasts for one day. Children's groups can be shortened or merged, if there are 4 or fewer children. A guaranteed maximum group size is not agreed upon. If a maximum number of participants is mentioned, it represents an average number of participants for this type of course. This may vary depending on the skill levels assigned.
Classes are not canceled due to prevailing weather conditions (force majeure). Private lessons take place in all weather conditions. If, due to safety reasons related to weather conditions, it is not possible to conduct a course, The Ski School reserves the right to postpone or cancel the course. The course card is non-transferable, and unused course days expire.
The Ski School disclaims all liability for any accidents that may occur before, during, or after ski instruction. It is the responsibility of the course participant to ensure adequate accident and liability insurance. Unless otherwise stated in the course description, lift tickets or equipment are not included in the course price. However, if the use of the Planberg and Wiesen lifts is included in the courses, the operating and usage conditions posted there apply. Failure to comply with the operating and usage conditions may result in the participant being unable to attend the lesson, and in this case, they are not entitled to compensation.

Injury and Illness
We recommend travel and cancellation insurance. In case of illness, The Ski School will provide confirmation of unused course or rental times based on a domestic medical certificate for your travel insurance. In the event of injury, the unused portion of the course or rental will be refunded from the day following the report, exclusively with a domestic medical certificate. Measures related to Covid19 are subject to official regulations and the current situation; therefore, changes may occur during the season.

Cancellation
We recommend travel and cancellation insurance. Please inform us promptly of any planned changes. Courses can be rescheduled up to 4 days before the start of the course in consultation with the ski school office. Cancellation is possible up to 3 days before the start of the course or rental, minus a processing fee of 10%. The remaining amount will be refunded to an account provided by you. For cancellations of group courses up to 24 hours before the start of the course, the processing fee is 30%. We will issue a voucher for the remaining amount, which is valid for a maximum of 13 months. In case of later cancellation or no-show, costs will not be refunded.
Rental and Booking of ski and snowboard equipment.
Each renter is liable for the proper return of the equipment up to the value of the purchased product. Upon collection of the equipment, you may be asked to provide additional data required for adjustment. You can also enter your adjustment data in advance on the website sport-leithner.at/checkin.
Sport Leithner is entitled to request a security deposit in the form of the deposit of a document (passport, identity card, driver's license) or a deposit. The deposit of a security does not count as a possible purchase price for the equipment parts. Otherwise, the rental conditions provided during the rental process apply.

Content of the Online Offer
The ski school/ski rental (hereinafter referred to as the "author") assumes no liability for the timeliness, correctness, completeness, or quality of the information provided. Liability claims against the author for damages of a material or immaterial nature caused by the use or non-use of the information provided, or by the use of incorrect or incomplete information, are excluded to the extent that the author has not acted demonstrably intentionally or with gross negligence. All offers are non-binding and subject to change without notice. The author expressly reserves the right to change, supplement, or delete parts of the pages or the entire offer without separate announcement.

Jurisdiction, Place of Fulfillment, and Legal Options
The place of fulfillment for all courses, rentals, and services is the registered office of Schischule Pertisau, A-6213 Pertisau. 
For all legal disputes related to online bookings via this site, Austrian law applies exclusively (excluding the IPRG), and only the competent court at the registered office of the Schischule Pertisau has jurisdiction. The contract language is German. If any part of the terms and conditions is invalid, it shall be replaced by a provision that reflects the original intention as closely as possible. The remaining provisions shall remain unaffected. 
The course participant agrees that photos/films taken during their visit to The Ski School may be published on the internet and in brochures of the ski school's BOBO's KINDERCLUB.

References and Links
In the case of direct or indirect references to external websites ("links") that are beyond the author's responsibility, liability would only come into effect if the author is aware of the content and it is technically possible and reasonable for them to prevent usage in the event of unlawful content.
